JAWBONE Act

What it does
- Amends the Communications Act of 1934 to create a federal private right of action against federal agencies or employees that coerce broadcasters, interactive computer service providers, or artificial intelligence system providers to take content actions.
- Defines 'coerce' to include taking, implying, or threatening harmful, hostile, or unfavorable actions, with factors including word choice, regulatory authority, references to adverse consequences, and whether the communication led the recipient to act contrary to its own policies.
- Creates exceptions to the prohibition for actions taken pursuant to lawful investigations or enforcement of law that do not violate the First Amendment, actions authorized by warrant, and directions relating to official use of platforms by the government.
- Places the burden on agencies and employees to establish that an exception applies when defending against civil actions brought under the statute.
