FLOWS Act

What it does
- Exempts licensees from obtaining Federal Energy Regulatory Commission approval for nonsubstantial alterations or additions to hydropower project works if performed under Commission-approved plans.
- Exempts licensees from obtaining Federal Energy Regulatory Commission approval for routine maintenance, repair, or replacement of project works or seasonal and temporary operational adjustments in response to circumstances beyond the licensee's control.
- Authorizes the Federal Energy Regulatory Commission to issue 10- to 20-year licenses for micro hydrokinetic energy projects with installed capacity of not more than 5 megawatts that convert energy from waves, tides, currents, or free-flowing water without impounding water.
- Requires the Federal Energy Regulatory Commission to complete licensing decisions for micro hydrokinetic projects within 1 year of application and to establish joint schedules with other federal and state agencies to meet expedited timelines.
