Reliable Power Act
Sponsor: Tom Cotton (R-AR)
What it does
- Requires the ERO to conduct annual long-term assessments of the bulk-power system's ability to supply sufficient electric energy, analyzing generation resource mix, transmission development, demand trends, and risks of supply shortfalls under normal and extreme weather conditions.
- Directs the ERO to publicly notify FERC when the bulk-power system faces generation inadequacy and may collect data from users, owners, and operators of the bulk-power system to conduct assessments.
- Requires FERC to notify the Department of Energy, the Environmental Protection Agency, and other relevant Cabinet-level agencies when generation inadequacy is declared.
- Requires Cabinet-level agencies to submit to FERC for review any regulations under development or consideration that directly affect generation resources in the bulk-power system, with submission deadlines tied to OMB review or Federal Register publication.
- Prohibits a Federal agency from finalizing a covered agency action affecting generation resources until the agency responds to FERC comments and FERC determines the action is not likely to significantly harm bulk-power system reliability.
