Access to Birth Control Act

What it does
- Requires pharmacies stocking contraceptives to dispense FDA-approved contraception and contraceptive-related medication without delay when in stock.
- Requires pharmacies to offer customers without-delay options to obtain out-of-stock contraception through referral, transfer, or expedited ordering.
- Prohibits pharmacies from creating environments that intimidate or threaten customers seeking contraception, or from having employees interfere with, misrepresent, deceive, or refuse service related to contraceptive requests.
- Establishes civil penalties of up to $1,000 per day per violation (capped at $100,000 per proceeding) and creates a private right of action with damages, injunctive relief, and attorney fees for contraceptive access violations.
