PROTECT USA Act of 2026

What it does
- Prohibits entities integral to U.S. national interests from complying with foreign sustainability due diligence regulations, including the European Union's Corporate Sustainability Due Diligence Directive.
- Exempts actions taken to comply with U.S. statutes or in ordinary business course, such as responding to consumer or investor information requests.
- Establishes a process allowing entities to petition the President for exemptions from the compliance prohibition based on hardship, with presumption of approval unless President denies within 30 days with written explanation.
- Prohibits adverse actions against U.S. entities for compliance with this Act and bars U.S. courts from recognizing foreign court judgments against U.S. entities related to foreign sustainability due diligence regulations.
- Authorizes the President to take actions in the public interest to protect covered entities from adverse actions and imposes civil penalties of up to one million dollars for violations.
