Deterring American AI Model Theft Act of 2026

What it does

• Establishes a framework for the Secretary of State to designate foreign countries as countries of concern based on their threats to closed-source AI models, in addition to China and Russia.
• Defines model extraction attacks as unauthorized querying that circumvents access controls, uses fraudulent credentials, or violates terms of service to replicate or improve another AI model.
• Excludes authorized model training conducted in compliance with terms of service or owner permission from classification as model extraction attacks.
