Federal Water Projects Consultation Improvement Act of 2026

What it does
- Requires the head of each action agency and the Secretary to ensure that covered water contractors have routine opportunities to discuss and submit information during development of biological assessments under the Endangered Species Act.
- Directs action agencies to inform and engage covered entities before considering agency actions that would reduce water delivery under Federal water project contracts, including the legal authority, scientific basis, and justification for rejecting alternatives with fewer water supply impacts.
- Requires the Secretary to provide draft biological opinions to covered entities for review and comment, and affords due consideration to any comments received during consultation.
- Directs the Secretary to inform and engage covered entities regarding reasonable and prudent alternatives and reasonable and prudent measures, including scientific data supporting each component and justification for rejecting alternatives with fewer adverse water supply and economic impacts.
