What it does
- Prohibits deceptive recyclable claims and requires manufacturers to disclose the percentage of consumers or communities with access to recycling programs, except where recycling is available to a substantial majority of consumers and the entire package is recyclable.
- Prohibits deceptive compostable claims and requires manufacturers to include qualifying descriptions and competent scientific evidence when claiming packaging is compostable.
- Prohibits deceptive reusable claims and requires manufacturers to provide a means for reusing packaging through collection systems or compatible products.
- Directs the Federal Trade Commission to issue non-binding guidance within two years on compliance criteria, third-party certification standards, and packaging material considerations.
- Establishes preemption of state and local packaging-claim requirements that are not identical to the federal standard, preventing a patchwork of regulatory approaches.
