Air Permitting Improvements to Protect National Security Act of 2025

What it does
- Allows the President to waive, in whole or in part, any requirement for an advanced manufacturing facility or critical mineral facility to offset increased emissions of any air pollutant when the President determines it is in the national security interests of the United States.
- Permits states to allow new or modified advanced manufacturing facilities or critical mineral facilities to offset emissions by alternative or innovative means if the facility demonstrates all reasonable means to obtain offsets have been used and sufficient offsets are unavailable.
- Authorizes state permitting authorities to impose alternative offset measures or emissions fees (not to exceed 1.5 times the average cost of stationary source control measures adopted in the area during the previous 3 years) in lieu of direct emissions offsets, with fees utilized.
- Defines advanced manufacturing facility as a facility whose primary purpose is the manufacturing of semiconductors or semiconductor manufacturing equipment, and critical mineral facility as a facility whose primary purpose is the extraction, processing, refining.
