Critical Minerals Supply Chain Resiliency Act of 2026

What it does

• Treats actions by the Secretary of Defense to expand domestic production of strategic and critical materials as covered projects under the Fixing America's Surface Transportation Act, without regard to standard section 41001(6) requirements.
• Requires the Permitting Dashboard under section 41003(b) of the Fixing America's Surface Transportation Act to include Defense Production Act section 303 actions for mining, beneficiation, processing, and by-product recovery projects.
• Allows project sponsors to opt out of covered project treatment and Permitting Dashboard inclusion for critical minerals actions taken under Presidential Determination 2022-11.
