GUARD Veterans’ Health Care Act

What it does
- Permits the Department of Veterans Affairs to recover costs from Medicare Advantage and Medicare prescription drug plans for health care items and services furnished to enrolled veterans, effective January 1, 2026.
- Requires Medicare Advantage organizations and prescription drug plan sponsors to reimburse the Secretary for covered items and services without imposing additional documentation or utilization management requirements.
- Deposits reimbursements from Medicare Advantage and prescription drug plans into the VA Medical Care Collections Fund.
- Expands the VA's authority to recover reasonable charges for non-service-connected disability care from third parties, including tort settlements and liability recoveries, with a six-year statute of limitations for non-tort claims and three-year limitation for tort claims.
- Requires third parties to respond to VA cost-recovery claims within 45 days by paying a clean claim, paying an agreed amount, or providing notice of refusal with specified reasons or requesting additional information.
